These terms and conditions (Terms, Agreement) are an agreement between NAY LLC (us, we, or our) and you (User, you, or your). This Agreement sets forth the general terms and conditions of your use of the www.yoursvital.com website and any of its products or services (collectively, Website or Services).

By using the Website and purchasing and products or Services available through the Website, you acknowledge that you have read this Agreement and agree to be bound by all its terms and conditions.

If you do not agree to abide by the terms of this Agreement, you are not authorized to use or access the Website or use its Services.

Information About Us

1. This Website is owned and operated by NAY LLC, a company registered in the United Arab Emirates with its registered office at Al Saaha Offices, B Souk Al Bahar, Downtown, Dubai UAE.

Age Requirement

2. You must be at least 16 years of age to use this Website. By using this Website and by agreeing to this Agreement you warrant and represent that you are at least 16 years of age.

Legal Status of these Terms 

3. By placing an order for products through our Website, you are confirming that you intend to enter into a contract with us for the purchase of those products on these Terms. 

4. These Terms set out the entire agreement between you and us and supersede any and all prior terms, conditions, warranties and/or representations to the fullest extent permitted by law.

5. Any attempt by you to unilaterally add new terms, amend these Terms, or otherwise alter the terms on which we contract with you is agreed by you to be null and void.

Order and Payment

6. You may place an order for products on our Website by selecting the product(s) you wish to purchase, adding them to your basket, and then by clicking the ‘Confirm Order’ button at the end of the checkout process and completing the checkout process. 

7. During the checkout process, you will be asked to provide several personal details. All fields indicated as compulsory must be completed for us to process your order (e.g. providing us with your name, delivery address (if applicable), payment details, a valid telephone number, and email address).

8. We will then send you an email confirming receipt, the details of your order and the delivery costs which will be added to the purchase price (if applicable).

9. If we cannot supply you with the products you ordered, for whatever reason, we will not process your order and will inform you of this. If you have already paid for the products we will provide you with a full refund as soon as reasonably possible.

10. You shall pay all fees or charges in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. 

11. We accept payments online using [Visa and MasterCard credit/debit card and Apple Pay in United Arab Emirates Dirhams].

12. Please note that neither completion of the online checkout process nor our confirmation email constitutes legal acceptance of your order. Legal acceptance of your order will occur only upon receipt of full payment from you.

14. Where you use a credit or debit card to pay for your order, you confirm that the credit/debit card that is being used is yours or that you have been specifically authorized by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to us, we will not be liable for any delay or non-delivery.

15. Private payment data exchange happens over a SSL secured communication channel and is encrypted and protected with digital signatures, and our Website is also in compliance with PCI vulnerability standards to create as secure an environment as possible for Users. Scans for malware are performed on a regular basis for additional security and protection.

16. If, in our judgment, your purchase constitutes a high-risk transaction, we will require you to provide us with a copy of your valid government-issued photo identification, and possibly a copy of a recent bank statement for the credit or debit card used for the purchase. 

17. We reserve the right, at our sole discretion, to: 

a. change products and product pricing at any time; 

b. refuse any order you place with us;

c. limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address; and / or

d. recall any order you place with us.

18. If we make a change to, recall, or cancel an order, we will notify you by contacting the e-mail address provided at the time the order was made.

Delivery

19. We can only process orders for delivery or collection within countries in which we are permitted to sell the products.

20. Please note that delivery charges and timescales vary depending on the type of products ordered, the service you select and the delivery address.

21. We will try our best to deliver the products to your address by the estimated delivery date set out in our order confirmation email. If we are unable to meet our estimated delivery date, we will contact you as soon as we can with a revised estimated date. We will inform you when the order has been delivered to your address.

22. If you have selected delivery to your address and no one is available at the specified address at the time of delivery, our delivery company will contact you to arrange re-delivery. The Products will only be left with a third party (such as building caretaker or a maid) with your express authority.

23. All risk in the products you order (including risk of loss and/or damage to the products) shall pass to you when they are delivered to the delivery address specified in your order and we will not be liable for a refund or a replacement of the products in the event the address you specified is incorrect. 

24. Occasionally, the supply of your products may be delayed or prevented for reasons beyond our control (e.g. material shortages, import delays or higher than anticipated demand). Where this is the case, we will make every effort to keep you informed but shall be under no liability to you for such delay or failure.
